BY BROWSING, AND/OR USING THE SIMPLE-TALK.COM ("SIMPLE-TALK") WEBSITE ("SITE") OR CLICKING "I ACCEPT" WHEN PROMPTED IN CONJUNCTION THEREWITH, YOU ("USER") ACCEPT ALL OF THE TERMS AND CONDITIONS CONTAINED HEREIN. IF YOU ARE ACCEPTING THESE TERMS AND CONDITIONS ON BEHALF OF ANOTHER PERSON OR LEGAL ENTITY, YOU REPRESENT AND WARRANT THAT YOU HAVE FULL LEGAL AUTHORITY TO ACCEPT ON BEHALF OF AND BIND THAT PERSON OR LEGAL ENTITY TO THESE TERMS.

Privacy 

User's email address and any other personal identifying information that is provide will not be displayed on the Site and will not, under any circumstances, be distributed to any third party organization. Further, User's should not make public the email address of another User without that User's prior express permission.

Once a User has registered on Simple-Talk, a User's email address will be used only to send our newsletters and/or to alert Users to any Site event about  which a User has explicitly requested to be notified (for example, a new post on a particular forum).

The Simple-Talk Site server is hosted in the USA. To comply with EU Data Protection requirements, by accepting these terms and conditions a User provides consent to such User's information either being transferred to and/or stored in the USA.

General Use and Management of the Site

The forum, blog and article commenting facilities are expressly for posting and answering relevant technical questions and comments. The Site may not be used to distribute spam, advertisements or other similar messages. Simple-Talk have the right to remove, modify or suspend any posts that we feel violate its policies or the law, whether stated, implied or otherwise. Simple-Talk will remove, modify or suspend any information or content that it deems, in its sole opinion, to be inappropriate, including but not limited to information or content that is abusive, defamatory or libellous, discriminatory, pornographic or containing sexual content, intellectual property right infringements or anything that brings Simple-Talk or any of its owners, affiliates, employees, partners or contributing authors into disrepute.

Simple-Talk may change the format and content of the Site at any time. Simple-Talk may also suspend the operation of the Site for support or maintenance work, in order to update the content of the Site, or for any other reason. 

Simple-Talk reserves the right to terminate a User's access to the Site at any time and without notice.  

Users are responsible for complying with all applicable local laws in the jurisdiction within which a User accesses the Site and/or is registered to use the Site.

Simple-Talk Copyright Notice and Intellectual Property Rights


Any information or content provided on the Site (for example in the form of information in forums or blogs) is protected under copyright or other intellectual property right, owned by Simple-Talk or Simple-Talk's licensors. 

Simple-Talk does not want Users to, and Users should not, send any confidential information or post confidential information to the Site.

A User shall retain the ownership of any intellectual property rights in information or content submitted to the Site. By accepting these terms and conditions and sending information to the Site a User hereby, to the extent of its legal rights to do so, grants Simple-Talk a non-exclusive, fully paid-up, irrevocable, perpetual, world-wide, sub-licensable right under any and all of the User's intellectual property rights in or under the information or content for Simple-Talk to use, utilise, copy, reproduce, display, perform, modify, transmit, and distribute the information or content. 

Users may refer to information or content on the Site in books or articles and link to it from other online resources but Users may not copy, reproduce (whether by printing or downloading), modify, in whole or in part, distribute, broadcast or tamper with any information or content, without the written permission of Simple-Talk. Governing law and jurisdiction

These terms and conditions are governed by English law and in the event of any dispute arising in relation to these terms and conditions the English courts will have exclusive jurisdiction over such dispute. 

Changes to terms and conditions

Simple-Talk may change these terms and conditions from time to time. By entering a User password into the Site and browsing its contents Users are bound by the current terms and conditions, so Users should check these each time a User revisit the site.
